A business recession looms

Click Here to Visit Larry Kudlow at Kudlow and Company

The May jobs report was a shocker, with nonfarm payrolls up only 38,000 and private jobs up a mere 25,000. A lot of investors and economists are making the case that this was a weird, one-off, statistical glitch, and that stronger employment is on the way. They may well be wrong.

If you smooth out the numbers with a three-month moving average, job increases have been slowing for five months. The three-month pace last December was 281,000 jobs. In the May report, the pace nosedived to 107,000. The unemployment rate fell to 4.7 percent, but that’s largely because 458,000 people left the labor force.

This spells trouble for the economy. And if you step back and look at the whole business sector, a case can be made that the U.S. has been in a mild business recession for as much as a year, if not longer.

Take, for example, business fixed investment in equipment, software, plants, buildings, and so forth. This has been slowing for six straight quarters, and even went negative in the first quarter on a year-on-year basis.

Behind this business-investment slowdown, the broadest measure of profits from the GDP accounts, which very closely tracks IRS profits, has been negative for the past three quarters measured year-on-year. In fact, this slump began in the second half of 2014, almost two years ago.

Profits are the mother’s milk of stocks and the lifeblood of the economy. While so many people obsess about the Federal Reserve, the reality is that stocks have been flat over the past year as profits and business investment have been weakening.

Another point: Core capital goods, including orders, shipments, and backlogs, have turned negative over the past three months and across the past year. This is a proxy for business investment, and it’s not a good omen.

Finally, the closely watched ISM reports for manufacturing and services are barely above 50. In other words, they point to the front end of a recession. On the manufacturing side, key indicators like production and employment are below year-ago levels. New orders are flat. On the services side, the overall index is below year-ago levels, as is employment and new orders.

Many financial folks concentrate on consumption rather than business indicators, clinging to an outdated view that consumers are 70 percent of the economy. To be sure, consumer spending and housing are rising modestly. But new research by economist Mark Skousen of Chapman University shows that if you look under the hood of the GDP accounts, you will find that the intermediate stages of business production and services, including business-to-business activity, account for 50 percent of overall output. That’s higher than consumption, which runs about 40 percent.

As a result of Skousen’s work, the Bureau of Economic Analysis has created a new “gross output” measure, which is published with a lag. This GO measure tells us a lot more about the inside workings of the economy. And according to Skousen, 80 percent of all employment actually comes in the early and intermediate stages of business activity.

So let this be a warning. The overall economy is not yet in recession. But the business economy has been slipping for quite some time. And if falling profits and business investment continues, the jobs slowdown will follow suit -- if it hasn’t already.

As for Fed watching, in this environment the Fed should stay put. No rate hikes. The time for raising target rates was back in 2011, when QE2 drove the consumer price index up to 3.8 percent. That’s when it should have increased the target rate by a percentage point or so. If it had, it would have gotten back to Stanford economist John Taylor’s rule. We would have all been better off for it.

But now is the time to turn away from monetary policy and focus instead on fiscal solutions to the ailing economy. Slashing business tax rates to 15 percent for large and small companies and overturning burdensome regulations is what the economy needs to get out of the doldrums.

That would bring business investment back. The U.S. would be the most hospitable investment destination in the world. America would win the global race for capital. Cash would be put to work in productivity-enhancing investments. And the economy would grow by 4 or 5 percent for years.

Real interest rates, reflecting higher economic returns, would rise as a sign of economic health. And then the Fed could normalize its policies by following market rates higher.

For a time, the dollar would jump, again reflecting market forces and not currency manipulation. Then the G-20, with strong U.S. leadership for a change, could coordinate currency values and stability.

That’s my vision. Alas, we’re going to have to wait until next year.

Vets Number Could Be A Cemetery Plot

Visit the Michael Shannon Website
Here’s one federal employee who won’t be leaving “public service” to make millions in the private sector. Unless being the star in a dunk tank pays much better than I previously thought.

VA Secretary of Veterans Affairs Robert A. McDonald entered the realm of PR legend when he told reporters Disneyland doesn’t measure wait time for its customers, so why should the VA?

One reason keeping a handle on dwell time in the VA queue might be a good idea is, as far as my research can determine, not one person has died waiting to ride the Indiana Jones Adventure (although Harrison Ford has visibly aged).

The worst that can happen to customers in a Disneyland wait line is the occasional case of measles, which President Trump assures us will be as scarce as Mexicans after he takes office.

Waiting lines at the VA are considerably more dangerous. In 2013 alone, 40 veterans died waiting for their appointment with a VA doctor.

You’d think an organization that dealt exclusively with a clientele that knows how to handle firearms would be more customer–friendly. But you’d be wrong.

Illegals may be housed in Alabama

Alabama's U.S. Senator Richard Shelby released a statement in response to an announcement by the Office of Refugee Resettlement (ORR) at the Department of Health and Human Services that unaccompanied illegal immigrant minors could potentially be housed at Naval Out Lying Fields in Silverhill and Orange Beach, Alabama:
“The Obama Administration has once again shown an interest in potentially using Alabama’s military installations as temporary housing for illegal immigrants. These Department of Defense properties should be used for those men and women working to keep our nation safe – not to house illegal immigrants.
President Obama’s blatant disregard for our immigration laws has led us to this point, and we must not allow his actions to burden our nation’s military and local communities. I will fight against any attempts to allow those who break our laws to be housed at Alabama’s military facilities, and I urge the Administration to humanely and expeditiously transport these individuals back to their homes.”
Shelby Responds to Announcement That Illegal Immigrants Could Be Housed in South Alabama

"Fast and Furious" killings not going away

Click Here and Read the Full Story

Judicial Watch announced today released Justice Department documents showing that weapons sent from the U.S. into Mexico as part of the Obama administration’s Operation Fast and Furious gunrunning program have been widely used by major Mexican drug cartels.

According to the new records, over the past three years, a total of 94 Fast and Furious firearms have been recovered in Mexico City and 12 Mexican states, with the majority being seized in Sonora, Chihuahua and Sinaloa.

Of the weapons recovered, 82 were rifles and 12 were pistols identified as having been part of the Fast and Furious program. Reports suggest the Fast and Furious guns are tied to at least 69 killings.

Fast and Furious was a Department of Justice Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) “gunrunning” operation in which the Obama administration allowed guns to be sold to Mexican drug cartels in the hope the weapons would be recovered at crime scenes.

Fast and Furious weapons have been implicated in the murder of Border Patrol Agent Brian Terry and hundreds of other innocents in Mexico. Prior reports tie Fast and Furious weapons to at least 200 deaths in Mexico alone.

Judicial Watch obtained the documents last month in response to a March 17, 2016, Freedom of Information Act (FOIA) request to Bureau of Alcohol, Tobacco, Firearms and Explosives seeking the following:

All records identifying the locations (including, but not limited to, crime scenes and the locations of seizures) at which firearms – that were identified during the course of or due to Operation Fast and Furious – have been recovered by law enforcement personnel. The documents show 94 Fast and Furious firearms were seized, 20 were identified as being involved in “violent recoveries.” The “violent recoveries” involved several mass killings:

  • June 30, 2014 — One 7.62mm rifle recovered in Tlatlaya, Estado de Mexico. This is the reported date and location of a shootout in which 22 people were killed.
  • May 22, 2015 — Two 7.62mm rifles recovered from the site of a massive shootout in Rancho el Sol, Michoacán, that left one Mexican Federal Police officer and 42 suspected cartel members dead.
  • August 7, 2015 — One 7.62mm rifle was among five firearms reported as recovered from an abandoned stolen vehicle in which three dead shooting victims were found in Parral, Chihuahua.
  • January 29, 2013 — One 7.62mm rifle seized in Hostotipaquillo, Jalisco is reportedly related to the assassination of the town police chief, Luis Lucio Astorga and his bodyguard.
  • January 11, 2016 — One .50 caliber rifle seized from the Joaquin “Chapo” Guzman’s hideout in Los Mochis, Sinaloa, where he was (re)arrested.

On October 2014, Judicial Watch uncovered the fact that an AK 47 rifle used in a July 29, 2013, gang-style assault on an apartment building that left two people wounded was part of the Obama Department of Justice’s Fast and Furious gunrunning program.

“These documents show President Obama’s legacy includes one of gunrunning and violence in Fast and Furious,” said Judicial Watch President Tom Fitton. “As the production of documents from the ATF continues, we expect to see even further confirmation of Obama’s disgraced former Attorney General Eric Holder’s prediction that Fast and Furious guns will be used in crimes for years to come.”

In 2014, Judicial Watch litigation forced the disclosure of Fast and Furious documents to Congress after years of delay.

Judicial Watch has a related active lawsuit seeking access to all records of communications between the Department of Justice and the House Oversight Committee relating to settlement discussions in the Committee’s 2012 contempt of Congress lawsuit against then-Attorney General Eric Holder (Judicial Watch v. Department of Justice (No. 1:13-cv-1344)). The contempt citation stemmed from Holder’s refusal to provide documents to Congress related to the Fast and Furious gunrunning scandal.

In Clinton - "Americans Don't Trust"

A reputation for dishonesty has trailed Hillary Clinton
from her earliest days in national life.
One year ago this month, a Quinnipiac University poll of voters in three swing states highlighted a looming problem for Hillary Clinton's presidential campaign: More than half the respondents in each state regarded her as dishonest. A nationwide CNN poll the same month yielded similar findings: Fifty-seven percent of voters said Clinton was not trustworthy.

A reputation for dishonesty has trailed Hillary Clinton from her earliest days in national life. Democratic sages brushed the matter aside. "Does Hillary Clinton's Trustworthiness Matter?" asked Time magazine in a story at the time.

The consensus of the experts it quoted: Nah, not really. "People are looking first and foremost for someone who will . . . get things done for them," said Democratic pollster Geoff Garin. Honesty wasn't essential to victory. After all, went the argument, Bill Clinton won two presidential elections, despite widespread doubt about his trustworthiness. For that matter, so had Richard Nixon.

But Clinton's dishonesty problem hasn't gone away. When Gallup asks Americans what word first comes to mind when they hear Clinton's name, by far the most common answer is some version of "Dishonest/ Liar/ Don't trust her/ Poor character."

It isn't only Republicans or conservatives who are repelled by Clinton's honesty deficit. Exit polls during this year's primaries showed that among Democrats who said that honesty was the value they prize most in a presidential candidate, Bernie Sanders racked up huge margins over Clinton. He carried 91 percent of those voters in New Hampshire, for example, and 82 percent in Wisconsin.

With the release last week of a report by the State Department's inspector general on Clinton's misuse of official e-mail, the former secretary of state's reputation for mendacity only grew worse.

For a year or more, Clinton has insisted that she broke no rules by maintaining her own private email server to conduct government business. She repeatedly claimed that she had nothing to hide from investigators.

That she was "more than ready to talk to anybody anytime." That her reliance on a back-channel for email violated no security protocols. That it was not only "allowed by the State Department," but that the department had "confirmed" that it was allowed. That her use of a private server was "fully aboveboard." That everyone she had dealings with in the government knew about it.

But the inspector general's report shreds those claims.

  • No, Clinton never sought legal approval to use a private server for email. If she had made such request, it would have been denied.
  • No, Clinton was not "more than ready" to cooperate with investigators: Unlike four other secretaries of state (John Kerry, Condoleezza Rice, Colin Powell, and Madeline Albright), Clinton refused to be interviewed by the inspector general. Six of her aides refused as well.
  • No, Clinton's "homebrew" server setup was not common knowledge. Even President Obama knew nothing about it.
  • No, Clinton's behavior wasn't "fully aboveboard." When State Department staffers voiced concerns about her insecure email channel, they were silenced by their superiors and instructed "never to speak of the secretary's personal email system again."

The State Department's inspector general issued a report that demolishes
Hillary Clinton's claim that her use of a private computer server
for government business was "fully aboveboard."

A reputation for dishonesty has trailed Clinton from her earliest days in national life. The controversy over her email deceptions is only the most recent, and not necessarily the most outrageous. (More contemptible, to my mind, was publicly blaming the murder of four Americans in Benghazi on an inflammatory internet video while privately acknowledging that it was a premeditated attack by Islamist terrorists.) So far, Clinton's lack of integrity hasn't derailed her political career. Maybe it never will.

Or maybe, as she competes for the White House against an opponent whose swollen ego and disregard for truth match her own, Clinton's sordid character will finally prove her undoing. "Crooked Hillary," Donald Trump has gleefully nicknamed her.

The more he repeats the label, the more indelibly it will stick. Clinton's honesty gap may have seemed manageable a year ago, but that was before Trump's scorched-earth tactics changed everything.

Now even the State Department all but calls its ex-boss "Crooked Hillary." How much more can her electability withstand?

Resistance to Tolerance Is Futile

The legions of “tolerance” have crushed
another dissenter
Ron Schneider, owner of Leon’s Frozen Custard in Milwaukee, has been forced to surrender his English–only ordering policy after complaints from ethnic agitators. It started Tuesday, May 17th, when a customer in front of a prickly Hispanic tried to order his custard in Spanish.

The server replied, “I’m not allowed to speak Spanish to you.”

This exchange prompts a number of questions, beginning with why did the customer speak Spanish in the first place? Unless I’m in the Home Depot parking lot, strangers never come up to me speaking Spanish. A gutless Congress may not have ruled English as the nation’s official language, but the citizens certainly have.

One can only conclude the server appeared to be Hispanic and the customer assumed she spoke Spanish, too. This is certainly ethnic stereotyping, but we’ll let it pass.

Next the customer evidently re–ordered in English, was served and went on about his business exiting this column forever.

That would have been the end of the encounter, if Mr. Prickly hadn’t been there. Normally he orders in English, but evidently he prefers his frozen treats with a sprinkling of outrage. So Mr. Prickly makes a big production of ordering in Spanish, only to get the same response.

After getting his custard, the next stop wasn’t the napkin dispenser. It was Social Media: The home of manufactured outrage provided by the ignorant and easily offended.

Naturally Schneider and his operating policy were characterized as “racist.”

As the term is currently used, “racist” has no intrinsic meaning. As the great historian Paul Johnson wrote in his excellent “Modern Times.” The word was changed irretrievably in March 1975. An effort to expel Israel from the UN was blocked. As an alternative those midgets of diplomacy passed a resolution condemning Israel as “racist.”

Johnson writes, “As the American delegate Leonard Garment pointed out, the resolution was 'ominous' because it used 'racism' not as the word 'for a very real and concrete set off injustices but merely as an epithet to be flung at whoever happens to be one's adversary.' It turned 'an idea with a vivid and obnoxious meaning' into 'nothing more than an ideological tool.”

A tool limited to the Left and used most recently on custard impresario Schneider.

In a society that hadn’t completely lost it’s moorings, a trivial and foolish complaint like this would be ignored. Schneider’s wife is Hispanic and his kids are Hispanic making it tough to be a racist if he wants to eat dinner at home.

Second, English–only has been Leon’s policy for the past decade.

But facts didn’t matter to fulltime ethnic chauvinist and part–time legislator JoCasta Zamarripa. Interviewed by the Daily Mail, she says Schneider’s policy is illegal and he “owes the community an apology.”

No. He owes the community a good product at a good price and that’s it.

A variety of more Hispanic–than–thou organizations jumped into the manufactured controversy, united in their belief that someone should sic the government on Schneider before he started putting Trump signs in the parking lot.

Distraught Anglos considered dieting, rather than eat frozen custard tainted by the stain of nationalism. #BOYCOTTLEONS gained a bit of social justice momentum as protesters began gathering. A competing business, Bounce Milwaukee, had an inspired response and offered free ice cream to anyone who ordered in a foreign language.

English–speakers, as is customary here, had to pay full freight.

Trump can wait these ethnic popinjays out. He can also afford lawsuits. But Schneider can’t. He subsequently announced his employees would be allowed to speak other languages, “If you can help the customer, just help them any way you can,” he told a local broadcast outlet.

Zamarripa’s contribution to the controversy is employees are now expected to conduct business in multiple languages for the previously English–only pay.

Unfortunately, Leon’s isn’t off the hook. The wheels of government social justice grind slowly and are designed to grind you to powder. This time next year Leon’s may be under new ownership and called León’s.

This incident only proves Pancho Villa invaded the United States 100 years too early. In 1916 after he crossed the border and attacked Columbus, NM, Uncle Sam sent Gen. John J. Pershing (and my grandfather’s field artillery) to chase Villa down and bring him to justice.

Today Barack Obama would send social workers bearing vouchers.

Liberals - What Standards?

Syndicated talk radio host Chris Plante often says on his show "if it weren't for double-standards then liberals would have no standards at all."

Unfortunately, Plante is right. The increasingly hostile far-left is becoming more and more brazen about their disdain for the rule of law and common standards. This is deeply troubling because even young children are capable of understanding the benefits of rules and common standards.

When a group of kids get together and form a club or play a game, they usually agree on a set of "club rules" or the rules of the game before they begin playing. These commonly agreed upon rules prevent cheating and preserve a sense of fairness and equity.

By agreeing on "the rules," kids understand that the winner of the game they are playing will have won on merit and, in the case of the club, all of those agreeing to be members of the club agree to forfeit absolute control over their decisions within the club for a collective decision making process defined by the agreed upon process.

If kids can agree that rules and standards matter, why can't liberals do the same? How can we continue to move forward as an ideologically-diverse yet ultimately cohesive and respectful nation when one side of this perpetual ideological struggle writes one set of "rules" for itself, and another set of rules for others?

The Obama Overtime Rule Failed at IBM

Click Here to Visit the Judicial Watch Website

Juggling work and family life is hard. On Wednesday the Labor Department made it even harder for millions of salaried workers. The administration’s new overtime regulations will effectively turn them into hourly employees.

The regulation won’t increase their earnings, but it will greatly reduce their control over their schedules. The Fair Labor Standards Act requires employers to pay hourly workers overtime for working over 40 hours a week.

But the Fair Labor Standards Act regulations exempt many salaried employees. This makes sense: Salaried employees get paid to do a particular job, not work particular hours. They also generally have more control over when and where they work.

Many salaried employees have the flexibility to do things like take off early in the afternoon to attend a child’s soccer game, and then finish their work from home in the evening when their child has gone to sleep. Similarly, millions of salaried employees telecommute at least once a month.

On Wednesday it raised the overtime “threshold” test for salaried employees to $47,500 a year. All salaried employees making less than that—no matter how advanced their job duties—now qualify for overtime. Their employers must pay time and a half when they work more than 40 hours a week.

On the surface this seems appealing. Why shouldn’t workers get extra pay for working longer hours? However, economic research shows that is unlikely to happen. Most employers respond to overtime laws by reducing base pay an offsetting amount. Combining new overtime pay and lower salaries, most workers will earn almost exactly what they made before.

This is what happened when IBM reclassified 7,000 salaried and technical-support workers as overtime-eligible in a lawsuit settlement. It also cut their base pay by 15 percent, leaving total earnings unaffected. Even liberal supporters of the rule concede that the “wage offer reflects expected overtime hours” and so there will be “no change at the margin” in pay.

The rule will change how employees work. Overtime-eligible salaried employees must carefully log their hours. Each time they respond to a work e-mail, take a work phone call, or do any other work from home, their employer must track and pay them for it. If they do not, they risk getting sued. Trial lawyers filed 8,800 Fair Labor Standards Act lawsuits in 2015, many of them for employers who did not compensate overtime-eligible employees for work done remotely.

In order to avoid lawsuits, many employers deny flexible work arrangements to overtime-eligible employees. Virtually all employers who permit remote work and flexible work arrangements allow overtime-exempt employees to use them.

Only about half allow workers covered by overtime regulations to do so. As the head of human resources for Pitney Bowes explained to reporters, the company turned down requests from overtime-eligible staff to work from home because: “You just don’t take the [legal] risk.”

The Labor Department says this regulation will help workers. It is much more likely to make balancing work and family even more difficult.
