Obama and EPA imperil minority welfare

“Clean Power Plan” would bring imaginary benefits – and real health and welfare damage from Paul Driessen and Roger Bezdek

The Obama Environmental Protection Agency and environmental activists frequently claim that climate change will disproportionately affect poor and minority communities. In their view, this justifies unprecedented environmental regulations, like EPA's pending “Clean Power Plan” (CPP) to reduce carbon dioxide and other greenhouse gas emissions from coal and gas-fueled power plants 30% by 2030.

But what effect will the regulation itself have on poor and minority communities?

The plan will result in higher electricity costs for businesses and families, lost jobs, lower incomes, higher poverty rates, reduced living standards, and diminished health and welfare, our exhaustive recent study found. This damage will be inflicted at the national level and in all 50 states. The CPP will impact all low-income groups, but hit America’s 128 million Blacks and Hispanics especially hard.
The EPA rules will:
1) more than double the cost of natural gas and electricity, adding over $1 trillion to family and business energy bills 
2) require average families to pay $1,225 more in inflation-adjusted dollars for power and gas in 2030 than in 2012 
3) destroy millions of jobs in companies and industries that can no longer compete, here or internationally 
4) significantly reduce U.S. economic growth every year for the next two decades, causing more than $2.3 trillion in total lost gross domestic product
Compared to whites, blacks and Hispanics already spend 50% and 10% more of their incomes on utilities, respectively, 20% and 90% more on food, and 10% and 5% more on housing. The EPA regulations will significantly increase the minority family “energy burden” – the percentage of annual household incomes they must pay for residential energy bills – and thus the number of families driven into energy poverty. Inability to pay energy bills is second only to inability to pay rent as the leading cause of homelessness, so increasing numbers of poor and minority families will become homeless.

Black and Hispanic household incomes will decline by increasing amounts every year, while their food and healthcare costs will climb significantly, since those business sectors will also have to pay much more for energy. The poverty rate will increase by more than 23% for blacks and more than 26% for Hispanics.

EPA’s rule will force poor and minority families to choose between buying food, putting gas in the car, going to the doctor, buying medicines, giving to their church, saving for retirement, or making mortgage, rent and car payments. Small businesses will have to find thousands more just to keep the heat, lights and air conditioning on, without laying people off or closing their doors. Factories, malls, school districts, hospitals and cities will have to pay millions more for energy.

By 2035, cumulative job losses resulting from the rule will total 7 million for blacks and 12 million for Hispanics. Most of these losses will occur in localities where blacks and Hispanics are most heavily concentrated. The rule will especially harm residents of seven states with the highest concentrations of blacks and Hispanics: Arizona, California, Florida, Georgia, Illinois, New York and Texas.

Entire communities could sink into poverty. Bread winners lucky enough to find work will be forced to take multiple jobs, commute longer distances, and suffer severe sleep deprivation. Families will have to cope with more stress, depression, drug and alcohol abuse, spousal and child abuse. Nutrition and medical care will suffer. More people will have strokes and heart attacks.

Senator Joe Manchin (D-WV) bluntly summed up the effects of EPA’s “clean power” rules. “A lot of people on the lower end of the socioeconomic spectrum are going to die,” he said.

Ironically, these are the very people that Obama and EPA claim to care about the most. As African-American author and news analyst Deneen Borelli observes, President Obama “is rewarding his overwhelming support by black voters with an energy policy that will significantly reduce their disposable income.” Indeed, she says, climate change is “the green movement’s new Jim Crow law.”

National Black Chamber of Commerce President Harry Alford accurately called EPA’s carbon dioxide regulation “a slap in the face to poor and minority families.”

Blacks and Hispanics work hard to provide better futures for their children. The EPA regulations will push the American dream even further out of reach for them. Their incomes will be less, their unemployment rates will increase substantially, and it will take those who are out of work longer to find another job. Blacks and Hispanics are often the “last hired and the first fired.”

These are real impacts. However, EPA refuses to consider them, much less tabulate them and compare them to supposed regulatory benefits. It won’t even acknowledge that the health and climate risks that its costly regulations will allegedly prevent are in fact speculative, exaggerated and even fabricated.

For almost 20 years, average planetary temperatures have barely budged, even as carbon dioxide levels “soared” from 0.03% all the way to 0.04% of Earth’s atmosphere. No category 3-5 hurricane has hit the United States for a record 9-1/2 years. Tornadoes, floods, droughts, polar bears, polar ice, sea levels and wildfires are all in line with, or better than, historic patterns and trends. Meanwhile, the Sahel is green again, thanks to that extra plant-fertilizing carbon dioxide, without which life on Earth would end.

Moreover, even if CO2 does drive climate change, slashing US greenhouse gas emissions would bring no benefits, since China, India and other developing nations will not be reducing their enormous emissions.

Other EPA rules are equally suspect. Its mercury regs are based on an imaginary group of US women who catch and eat 300 pounds of fish annually – and whose children would supposedly improve their IQs by an un-measurable 0.00209 points if coal-fired power plants are shut down. As to soot, EPA’s illegal experiments on 296 people found that even “dangerous” or “lethal” exposures harmed no one.

Our air is clean. We don’t need these job-killing, health-impairing EPA regulations. But our governing elites will not give up their power or perks – or their propensity for playing with people’s livelihoods, living standards, health and well-being, for virtually no climate stability, air quality or other benefits.

The good news is that all of this is not inevitable. A recent Supreme Court decision held that EPA should have considered these and other enormous costs from its “mercury and air toxics” regulations, before imposing the rules. The decision should give governors and federal and state lawmakers every incentive to resist EPA’s harmful and dictatorial actions, and not wait for the CPP regulation to go into effect.

A dozen states have already sued EPA over its Clean Power Plan, which is opposed by experts on both sides of the aisle – and even noted liberal constitutional scholar Laurence Tribe. Other states should join the suit, demand a full accounting of regulatory costs, and simply refuse to implement the plan.

As currently written, the regulation calls on unelected state environmental agencies to draft their own state plans and submit them directly to EPA for review and approval. Oklahoma Governor Mary Fallin has signed an executive order blocking her state's environmental agency from submitting a plan. Other states have introduced legislation to the same effect. More should follow them into battle.

The grim reality is that the EPA wants states to do their dirty work for them. By submitting a plan, states will become complicit in the agency's plan to shut down affordable, reliable power generation, destroy jobs and livelihoods, and plunge minority families deeper into poverty, hardship and ill health.

For the sake of their constituents, elected officials in Washington and state capitals have an obligation to fight this federal takeover of state authority. They should act soon. EPA is scheduled to release its final regulation in August, initiating a one-year period before states will be forced to comply.

As this deadline approaches, our elected officials should determine how best to confront – and resist – EPA’s latest power grab. They should remember that the jobs, economic well-being, health and very lives of millions of minority and blue-collar families hang in the balance.

Twin peaks – twin lies

Supposedly record-high temperature and carbon dioxide levels supposedly bring record chaos from the files of Paul Driessen and Tom Tamarkin

Exactly the Same Only Different
A recent NOAA article is just what Doctor Doom ordered. It claims the 18-year “hiatus” in rising planetary temperatures isn’t really happening. (The “pause” followed a 20-year modest temperature increase, which followed a prolonged cooling period.) The article states:

“Here we present an updated global surface temperature analysis that reveals that global trends are higher than reported by the IPCC, especially in recent decades, and that the central estimate for the rate of warming during the first 15 years of the 21st century is at least as great as the last half of the 20th century. These results do not support the notion of a ‘slowdown’ in the increase of global surface temperature.”

Published in Science magazine to ensure extensive news coverage before critics could expose its flaws, the report was indeed featured prominently in the national print, television, radio and electronic media.

It’s part of the twin peaks thesis: Peaking carbon dioxide levels will cause peaking temperatures, which will lead to catastrophic climate and weather. Unfortunately for alarmists, the chaos isn’t happening.

No category 3-5 hurricane has hit the United States for a record 9-1/2 years. Tornadoes, droughts, polar bears, polar ice, sea levels and wildfires are all in line with (or improvements on) historic patterns and trends. The Sahel is green again, thanks to that extra CO2. And the newly invented disasters they want to attribute to fossil fuel-driven climate change – allergies, asthma, Islamic State and Boko Haram – don’t even pass the laugh test.

The NOAA report appears to have been another salvo in the White House’s attempt to regain the offensive, ahead of the Heartland Institute’s Tenth International Climate Conference. However, a growing number of prominent analysts have uncovered serious biases, errors and questions in the report.

Climatologists Pat Michaels, Dick Lindzen, and Chip Knappenberger point out that the NOAA team adjusted sea-surface temperature (SST) data from buoys upward by 0.12 degrees Celsius, to make them “homogenous” with lengthier records from engine intake systems in ships. However, engine intake data are “clearly contaminated by heat conduction” from the ships, and the data were never intended for scientific use – whereas the global buoy network was designed for environmental monitoring.

So why not adjust the ship data downward, to “homogenize” them with buoy data, and account for the contamination? Perhaps because, as Georgia Tech climatologist Judith Curry observed, this latest NOAA analysis “will be regarded as politically useful for the Obama administration.” However, it will not be “particularly useful” for improving our understanding of what is happening in Earth’s climate system.

Dr. Curry and the previously mentioned scientists also note that the buoy network has covered an increasingly wide area over the past couple decades, collecting high quality data. So again, why did NOAA resort to shipboard data? The ARGO buoys and satellite network (both omitted in this new analysis) do not show a warming trend – whereas the NOAA methodology injects a clear warming trend.

Canadian economist and statistical expert Ross McKitrick also analyzed the NOAA approach. He concluded that it wipes out the global warming hiatus that eight other studies have found. Its adjustments to SST records for 1998-2000 had an especially large effect, he says. Dr. McKitrick also recaps the problems scientists have with trying to create consistent temperature records from the multiple measurement methods employed over the centuries.

Theologian, ethicist and climate analyst Calvin Beisner provides an excellent summary of all these and other critiques of the deceptive NOAA paper.

It is also important to note that, in reality, NOAA is quibbling about hundredths of a degree – essentially the margin of error. On that basis it rejects multiple studies that found planetary warming has stopped.

Britain’s Global Warming Policy Forum succinctly concludes: “This is a highly speculative and slight paper that produces a statistically marginal result by cherry-picking time intervals, resulting in a global temperature graph that is at odds with those produced by the UK Met Office and NASA,” as well as by other exhaustive data monitoring reports over the past four decades.

The vitally important bottom line is simple.

The central issue in this ongoing debate is not whether Planet Earth is warming. The issue is: How much is it warming? How much of the warming and other climate changes are due to mankind’s use of fossil fuels and emission of greenhouse gases – and how much are due to the same powerful natural forces that have driven climate and weather fluctuations throughout Earth and human history? And will any changes be short-term or long-term … and good, bad, neutral or catastrophic?

At this time, there is no scientific evidence – based on actual observations and measurements of temperatures and weather events – that humans are altering the climate to a significant or dangerous degree. Computer models, political statements and hypothetical cataclysms cannot and must not substitute for that absence of actual evidence, especially when the consequences would be so dire for so many. In fact, even the “record high” global average temperature of 2014 was concocted and a margin of error.

Simply put, the danger is not climate change – which will always be with us. The danger is energy restrictions imposed in the name of controlling Earth’s perpetually fickle climate.

Moreover, the IPCC’s top climate official says the UN’s unelected bureaucrats are undertaking “probably the most difficult task we have ever given ourselves, which is to intentionally transform the [global capitalist] economic development model.” Another IPCC director says, “Climate policy has almost nothing to do anymore with environmental protection. The next world climate summit is actually an economy summit, during which the distribution of the world’s resources will be negotiated.”

That summit could give government officials and environmental activists the power to eliminate fossil fuels, control businesses and entire economies, and tell families what living standards they will be permitted to enjoy – with no accountability for the damage that will result from their actions.

For developed nations, surrendering to the climate crisis industry would result in fossil fuel restrictions that kill jobs, reduce living standards, health, welfare and life spans – and put ideologically driven government bureaucrats in control of everything people make, grow, ship, eat and do.

For poor countries, implementing policies to protect energy-deprived masses from computer-generated manmade climate disasters decades from now would perpetuate poverty and diseases that kill them tomorrow. Denying people their basic rights to have affordable, reliable energy, rise up out of poverty, and enjoy modern technologies and living standards would be immoral – a crime against humanity.

Countries, communities, companies and citizens need to challenge and resist these immoral, harmful, tyrannical, lethal and racist EPA, IPCC, UN and EU decrees. Otherwise, the steady technological, economic, health and human progress of the past 150 years will come to a painful, grinding halt – sacrificed in the name of an illusory and fabricated climate crisis.

Skeptics gather in D.C.

On Thursday and Friday, June 11-12, there will be a gathering of some of the nation’s and the world’s leading climate change “skeptics” in Washington, D.C. and joining them will be members of Congress and their staffs. The Tenth International Conference on Climate Change will occur and the odds are that the mainstream media, as it has done for all the previous conferences, will do its best to ignore it.

In attendance as well will be scores of scientists, economists, and policy experts for a conference being held just two blocks from a White House in which the President of the United States resides while lying about “climate change” as the greatest threat to the planet.

In March, the Gallup Poll revealed that “Although climate scientists have been in the news describing this winter as a strong signal that global warming is producing more extreme weather, Americans are no more likely today (55%) than in the past two years to believe the effects of global warming are occurring.”

The Conference is sponsored by The Heartland Institute, a Chicago-based free-market think tank and, while most of us have heard of the Rand Corporation or the Heritage Foundation, Heartland is one of the those power houses that labors without the “image” accorded others.

Founded in 1984, it has a full-time staff of 31 with approximately 235 academics and professional economists who participate in its peer-review process, plus more than 160 elected officials who serve on its Legislative Forum. In addition to the environment, its scholars also focus on education, health, budget and tax issues.

I have been a Heartland policy analyst for so long I can’t recall when I joined. Approximately 8,300 supporters contribute to its annual budget of $6 million. It does not accept government funding.

Without your knowing it, the nine conferences that preceded the current one have had a dramatic impact on your life and wallet. For one thing, you’re not being robbed by a “carbon tax” aimed at “reducing greenhouse gases.” On the other hand, you may be at risk of losing a coal-fired plant that provides your electricity if the Environmental Protection Agency is allowed to continue its vile attack on our energy resources.

It has been Heartland and a handful of other think tanks that labored to inform the public about the science that utterly debunked the lies about “global warming” and now works to do the same for those applied to “climate change.” Heartland’s power is seen in its conferences.

The problem for Heartland and the rest of us is that we are up against the U.S. government whose Obama administration is completely committed to the lies; agency by agency within the government have budgets and programs to continue to telling the lies. Beyond them is the entire system of government schools and, beyond them, much of the higher education community.

In early June the Daily Caller reported that “National Oceanic and Atmospheric Administration scientists have found a solution to the 15-year ‘pause’ in global warming: They ‘adjusted’ the hiatus in warming out of the temperature record.” This is what Heartland and others have been fighting against and exposing since the global warming hoax began in the late 1980s. And we are beginning to see the Congress respond.

As reported by CNS News, appropriators in the House of Representatives have let it be known that they are taking aim at one of the Obama administration’s most cherished priorities—international climate change funding. An appropriations bill for the State Department and foreign operations excluded the Green Climate Fund, the Clean Technology Fund, and the Strategic Climate Fund, while also removing funding for the U.SN-backed Intergovernmental Panel on Climate Change. That’s millions in U.S. taxpayer funding that will not be wasted on the climate change hoax.

The Conference will honor some of the world’s leading “skeptics”—the alarmists call them “denier.” They include Sen. Jim Inhofe (R-OK) as the winner of the Political Leadership on Climate Change Award, sponsored by the Heritage Foundation. My friend, Robert M. Carter, Ph.D. will receive Heartland’s Lifetime Achievement in Climate Science award. Others whom you may not have heard of include William Happer, Ph.D., David Legates, Ph.D., and Anthony Watts, all of whom have been on the front lines of the battle for the truth about the planet’s climate.

An entire generation has grown up and graduated from college since the first lies about global warming were unleashed. That’s how long Heartland and others have labored to present the truth. If the media fails to take notice of this week’s conference, you will know that the battle will continue for a long time to come.

Predicting earthquakes - Not

The president of the Space and Science Research Corporation, John Casey, is also the author of “Cold Sun: A Dangerous ‘Hibernation’ of the Sun Has Begun!” and has called attention to a meteorological cycle that until the global warming hoax occurred, was largely unknown to many people and, to a large degree still is.

Nature has not cooperated with the charlatans who made claims about a dramatic warming of the Earth. Since 1998 the planet along with the Sun has been in a solar cycle distinguished by very few, if any, sun spots—evidence of solar storms—and a cooling of the Earth that has some predicting a forthcoming new Little Ice Age.

As Wikipedia reports: “Solar Cycle 24 is the 24th solar cycle since 1755, when extensive recording of solar sunspot activity began. It is the current solar cycle, and began on January 4, 2008, but there was minimal activity until early 2010. It is on track to be the Solar Cycle with the lowest recorded sunspot activity since accurate records began in 1750.” These cycles occur every eleven years.

I was surprised to receive a news release from the Space and Science Research Corporation (SSRC) on Monday with the headline “Earthquake and Volcano Threat Increases” because, frankly, I could have put out the same release and, if such activity did increase, I could claim credit for predicting it and, if not, few if any would recall I had made such a claim. While earthquake activity has been studied for decades, even the U.S. Geological Survey (USGS) makes no claim to being able to predicting when or where one will occur.

What the USGS can tell you is that their scientists (and others) “estimate earthquake probabilities in two ways: by studying the history of large earthquakes in a specific area and the rate at which strain accumulates in the rock.” A translation of this is that they have only the most minimal clues when and where one will occur. A recent International Business Times article reported that this may change as the introduction of “big data analytics” kicks in to provide “a leap of accuracy of quake predictions.”

The SSRC news release was about a letter that Casey had sent Craig Fugate, the Administrator of the Federal Management Agency which “disclosed that we are about to enter a potentially catastrophic period of record earthquakes and volcanic eruptions throughout the United States.”

Casey’s letter outlined “how the ongoing dramatic reduction in the Sun’s energy output will not only plunge the world into a decades-long cold epoch, but at the same time bring record geographic devastation in monster earthquakes and volcanic eruptions.”

Other scientists have come to similar conclusions, but after years of sorting through all the claims about global warming and “climate change”, one might want to tread lightly before embracing them.

I asked my colleague at The Heartland Institute, Science Director Jay Lehr, for his reaction and he was quite candid. “I have read it and am extremely skeptical. It sounds like the agency is looking for some press and, of course, when they turn out to be wrong no one will be upset. No harm. No foul. Being ready for earthquakes in known quake zones makes sense; creating unwarranted fear does not.”

Dr. Lehr summed up my own reaction. I would recommend his skepticism to everyone.

Will there be earthquakes here in the U.S.? Yes. The New Madrid earthquakes were the biggest in the nation’s history, occurring in the central Mississippi Valley and so large they were felt as far away as New York and Boston, Montreal and Washington, D.C. President James Madison and his wife Dolly felt them in the White House.

They lasted from December 16, 1811 through March of 1812 and there were more than 2,000 quakes in the central Midwest, and between 6,000-10,000 in the boot-heel of Missouri where New Madrid is located near the junction of the Ohio and Mississippi rivers.

When will new earthquakes or volcanic eruptions occur? I doubt anyone knows the answer to that.

Russian President Vladimir Putin is outraged that the United States has indicted 14 FIFA soccer officials, accusing them of corruption, racketeering, fraud and conspiracy, involving bribes totaling over $150 million in kickbacks for awarding tournament rights. He says the US is meddling in Russian affairs and plotting to steal the 2018 World Cup from his country. What chutzpah.

This is the same Mr. Putin who annexed Crimea and parts of Ukraine, and whose close cronies have been secretly channeling millions of dollars to US and EU environmentalist groups to oppose both American oil drilling in the Arctic and hydraulic fracturing – the game-changing process that is producing so much oil and gas that it’s slashed energy prices … and Russian revenues.

The Justice Department indictments generated global applause. Now the DOJ needs to conduct an equally zealous investigation into corruption, fraud and collusion in the Obama Environmental Protection Agency. Of course, that will never happen – no matter how rampant or flagrant the abuses have been.

As Kimberly Strassel documents in May 14 and May 21 articles, EPA emails and other documents reveal that the agency had already decided in 2010 to veto the proposed Pebble Mine in Alaska on ideological grounds, “well before it did any science” on the project’s potential environmental impacts. Meanwhile, an EPA biologist was working with eco-activists to recruit Native Americans to oppose the mine. “It’s not much of a leap,” Strassel writes, “to suggest that the EPA encouraged [petitions against the mine] so that it would have an excuse to intervene, run its science as cover, and block a project it already opposed.”

At the same time the biologist was aiding the petition drive, he was also helping to write EPA’s “options paper” for the mine – and lobbying his co-authors and report contributors to veto the mine, Strassel notes. Now, contrary to newly discovered agency emails, EPA bosses are pretending they never saw the options paper and trying to put the blame on low-level functionaries, when they were deep in cahoots all the way.

This represents incredible collusion, deception, fraud and abuse of power – to impose agency edicts and appease environmental ideologues in and out of EPA. Moreover, it is just the latest in a long line of abuses and usurpations by this Obama agency, under a culture of corruption and secretive, manipulated science used to justify regulatory overkill that imposes extensive damages for few or no benefits.

On climate, EPA relies on computer models and discredited IPCC reports to predict global catastrophes that it insists can be prevented if the United States slashes its fossil fuel use, carbon dioxide emissions and living standards, even if China, India and other developing countries do nothing. Meanwhile, real-world temperatures, hurricanes, tornadoes, polar ice and sea levels continue to defy the fear-mongering. So now the rhetoric has shifted yet again, to alleged national security and asthma threats from climate change.

Just this week, EPA announced that it will henceforth regulate any ponds, puddles, creeks, ditches and other waters that have a “significant nexus” to navigable waterways, even if that ill-defined connection enjoys six degrees of separation from streams in which you can actually paddle a kayak. EPA itself recognizes that “science” does not support its new regime, so now it says its “experience and expertise” justify regulating virtually all “waters of the United States” (WOTUS) – and thus of all lands, land uses, and family, farm and industrial activities not already covered by its climate and other rules.

Homeowners, farmers and businesses will now have to apply for permits to do almost anything that might theoretically pollute or affect waterways. Even taking a shower is now subject to EPA regulation.

On mercury, EPA is shutting down coal-fired power plants that emit barely 3% of all the mercury in US air and water. It claims this will prevent “0.00209 points” in American IQ losses and protect nonexistent “hypothetical female subsistence consumers” who every day for 70 years eat a pound of fish that they catch themselves in US navigable or “nexus” waterways.

For fine particulates, EPA wasn’t satisfied with regulations that prohibited more than one ounce of soot spread evenly in a volume of air a half-mile square by one story tall. When illegal experiments on humans failed to demonstrate that these levels were not actually “dangerous” or “lethal,” it imposed tougher standards anyway, as part of its war on coal.

Before he landed in jail for fraud, high level EPA bureaucrat John Beale concocted the sue-and-settle tactic, under which agency lawyers meet with environmentalist groups behind closed doors, agree to new regulatory standards, and then settle a friendly lawsuit whereby a court orders EPA to adopt the rules. Parties actually impacted by the new regulations never find out about them until it’s a “done deal.”

As presidential candidate Obama promised, under his policies electricity prices would “necessarily skyrocket.” But this means poor families, small businesses, factories, school districts, hospitals and churches must pay far more to keep their lights, heat, air conditioning and equipment running. That means people get laid off, fewer jobs are created, living standards decline, people’s health and wellbeing suffer, stress, depression, and drug and alcohol abuse increase, more people die during heat waves, and far more die during much deadlier winter cold snaps.

However, EPA ignores all these cold, hard realities – as it cherry-picks research and pseudo-science to support its agenda, ignores contradictory studies, and pays advisory boards and activist groups like the American Lung Association millions of dollars annually to rubberstamp and promote its decisions.

What can be done to curb these abuses and usurpations, and rein in this renegade agency?

Congress should cut EPA’s budget, to eliminate money that it routinely gives to activist and propaganda groups – and prevent the agency from spending any further taxpayer funds to regulate carbon dioxide, impose its new ozone, mercury and WOTUS rules, or participate in new sue-and-settle lawsuits.

Congress should also pass the Secret Science Reform Act, to ensure greater honesty and transparency in EPA rulemakings – and hold hearings on the Pebble Mine and other questionable agency actions, with EPA officials under oath and subject to penalties for perjury, malfeasance and criminality in office.

Presidential candidates must become well versed in these issues, discuss them during interviews and debates, and be prepared to amend, suspend and upend EPA decisions and regulations that were implemented in violation of transparency, integrity, and honest, robust science.

They should also examine how the federal EPA behemoth can be systematically dismantled and replaced with a “committee of the whole” of the 50 state environmental protection agencies – so as to balance and protect our needs for air and water quality, livelihoods, living standards, health and welfare.

State legislators, governors and attorneys general, companies and other aggrieved parties should continue to file lawsuits to block EPA excesses. However, they should stop relying on “abuse of discretion,” as courts almost always bow to government agencies. Instead, they need to demand that every agency decision is grounded in reliable, replicable, testable, peer-reviewed evidence, data and standards – as set forth in the Supreme Court’s Daubert, Joiner and Kumho decisions – and that the agencies demonstrate that they have fully accounted for the negative job, economic, health and welfare impacts of their rulings.

Meanwhile, as Charles Murray (author of By the People: Rebuilding liberty without permission) and others have suggested, states, communities, companies and individuals should engage in a new form of “systemic” civil disobedience: refusing to bow to harmful, nonsensical, tyrannical EPA regulations.

In short, we should take Dylan Thomas’s advice – and rage, rage against the dying of the light – due to regulations that are dimming the lights in our homes and the light of liberty and American exceptionalism.

A real climate threat to our national security

National security, the Seattle oil rig, hypocrisy, and Greenpeace’s dirty money from the files of Ron Arnold at The Center for the Defense of Free Enterprise


President Obama had it all wrong in his recent commencement address at the United States Coast Guard Academy in New London, Connecticut. He warned that climate change “deniers” endanger our national security – insisting that denial “undermines the readiness of our forces.”

In fact, climate change true believers are the real threat to our national security. That includes the notorious Seattle mob of Greenpeace “kayaktivists” who were recently paddling around Puget Sound, in kayaks made from petroleum, trying to stop Shell Oil’s Polar Pioneer Arctic drilling rig from making a layover at the Port of Seattle to gear up for Alaskan waters.

When thwarted by the Coast Guard’s 500-foot no-approach cordon, the Greenpeace canoe crowd left the harbor and took to the streets, where they blocked supplier access to the rig until city police dispersed them.

These angry picketers are the threat. They undermine America’s share of the Arctic Ocean’s estimated 30 percent of the world’s undiscovered natural gas and 13 percent of its oil reserves. That fuel could power the military as well as civilians.

How can slogan shouters endanger America’s national security when their targets are civilian oil rigs? Shell’s rigs will draw needed attention to the Chukchi and Beaufort Seas in an ocean filling with Russia’s growing Arctic supremacy. This month, Defense Secretary Ashton Carter told a Senate appropriations committee hearing that the U.S. military Arctic defense policy is falling short.

The United States lacks ships able to operate in or near Arctic ice. We have only two medium icebreakers, one of which is nearly a decade past pull date. Russia has 40 big icecap-crunchers, 25 of them nuclear-powered, including one battleship-size beast ominously named 50 Years of Victory (but it takes tourists to the North Pole for 15-day cruises at $30,000 and up).

Our entire Alaskan Arctic coast has no U.S. military base, not one. Russian jets make nearly monthly incursions to the Air Defense Identification Zones off the coast of Alaska. Interceptors have to fly to the north coast from Eielson Air Force Base near Fairbanks (500 miles) or all the way from Elemendorf AFB in Anchorage (725 miles).

President Putin strategically laid claim to great swaths of Arctic oil and gas with deployed rigs. He has activated the Northern Fleet – two-thirds of the entire Russian Navy – as a strategic military command. And he has assigned a 6,000-soldier Russian Arctic warfare unit to the archipelago of Novaya Zemlya, with next generation fighter aircraft in addition to advanced S400 Triumf anti-aircraft systems. An Arctic military reconnaissance drone base 420 miles off mainland Alaska is operational.

In February, President Obama seemed to have adopted the Greenpeace strategy of roll over and play dead, when he stripped Alaska of vast stores of its oil and gas wealth, by reducing offshore drilling and declaring most of the 19.6-million-acre Arctic National Wildlife Refuge off limits to oil production. Yet his administration approved a conditional permit for Shell’s Arctic oil exploration.

The United States “may be 40 years behind” Russia, Alaska’s Senator Lisa Murkowski told Defense Secretary Carter. This spring, the U.S. Northern Command is supposed to release a report that is expected to militarize the existing 2013 National Strategy for the Arctic Region. However, according to the strategy, as reported by Foreign Policy Journal, “the Navy’s role will primarily be in support of search and rescue, law enforcement, and civil support operations.”

Shell’s oil rigs provide peaceful reasons for our warships and planes to patrol the Arctic in counterbalance to Russia. Carter told Murkowski, “The Arctic is going to be a major area of importance to the United States strategically and economically to the future.”

Research by Chicago-area Heartland Institute found a secret beneath Greenpeace’s anti-oil ruckus: it is funded by oil-drenched millions from investments in ExxonMobil, Chevron, PetroChina and dozens of other fossil fuel firms, ironically including shares of Royal Dutch Shell, owner of the rig docked in Seattle.

According to Foundation Search, the top Greenpeace donor is the leftist-run David and Lucile Packard Foundation, which paid them a total of $2,146,690 since 2000. The deceased electronics mogul’s foundation managers boast 2013 assets of $6.9 billion.

They have invested enormous working capital into Anadarko Petroleum, Apache Corporation, Arch Coal, Carrizo Oil and Gas, Chevron, ConocoPhilips, Devon Energy, Duke Energy, ExxonMobil, Marathon Oil, Occidental Petroleum, Phillips66, Questar, Tesoro, Valero Energy, World Fuel Service (a defendant in lawsuits over the 2013 oil train explosion in Lac-Mégantic, Quebec that killed 47 people), and many others. They pay Greenpeace from the profits.

Second-ranked Greenpeace donor is the leftist-funding Arcus Foundation, which gave the Rainbow Warrior security threats $1,055,651 since 2007. Established by ultra-green billionaire Jon Stryker, Arcus’ 2013 assets totaled $169,472,585 – with working capital injected into China Petroleum, ExxonMobil, PetroChina, Royal Dutch Shell and TransCanada (the “tar” sands pipeline company). It also paid Greenpeace from its fossil fuel profits.

The list of foundations giving oil profits to Greenpeace goes on and on – and Greenpeace goes on and on hypocritically taking those oil profits to undermine America’s real energy future.

This cabal could redeem itself instantly: they could just stop using any fossil fuels right now.

The Harper climate pledge is hot air

Canada has no way to ensure that developing nations will keep their commitments ~ from the files of Tom Harris


In announcing the Stephen Harper government’s new greenhouse gas (GHG) reduction targets earlier this month, Environment Minister Leona Aglukkaq said Canada will “work with our international partners to establish an international agreement in Paris that includes meaningful and transparent commitments from all major emitters.”

But Canadians are being tricked.

Any GHG emission reduction pledges made by developing countries in Paris later this year will almost certainly not be enforced.

Written in bureaucratese, the convoluted first sentence in last December’s “Lima Call for Climate Action,” the United Nations’ last major climate change agreement, indicated exactly that.

It reads: “The Conference of the Parties, Reiterating that the work of the Ad Hoc Working Group on the Durban Platform for Enhanced Action (ADP) shall be under the Convention and guided by its principles...”

The ADP is the group of back room negotiators who are drafting the text for the big climate deal to be signed in Paris in December.

The “Convention” refers to the UN Framework Convention on Climate Change (UNFCCC), signed by former Canadian Prime Minister Brian Mulroney and hundreds of other world leaders at the Earth Summit in Rio in 1992.

And the ADP’s work will adhere to the UNFCCC, including its critical Article 4:
“The extent to which developing country Parties will effectively implement their commitments under the Convention will depend on the effective implementation by developed country Parties of their commitments under the Convention related to financial resources and transfer of technology and will take fully into account that economic and social development and poverty eradication are the first and overriding priorities of the developing country Parties.”
Translated, this means that, under any treaty based on the UNFCCC (which all UN climate agreements are), developing countries will keep their emission reduction commitments only if we in the developed world pay them enough and give them enough of our technology.

Also implied in the article is that, even if we give them everything we promise, developing countries may simply forget about their GHG targets if they interfere with their “first and overriding priorities” of “economic and social development and poverty eradication.”

Developed nations like Canada, on the other hand, do not have this option. We must keep our emission reduction commitments no matter how severely it impacts our economies.

It is not as if the UN has been hiding this “firewall” between developing and developed nations.

It has told us repeatedly in UN climate change agreements in Copenhagen, Cancun, Durban and Lima that, “development and poverty eradication,” not emission reduction, takes top billing for developing countries.

Actions to significantly reduce GHG emissions would entail dramatically cutting back on the use of coal, the source of 81% of China’s electricity and 71% of India’s.

As coal is by far the least expensive source of electric power in most of the world, reducing GHG emissions by restricting coal use would unquestionably interfere with development priorities.

So, developing countries simply won’t do it, citing the UNFCCC in support of their actions.

Some commentators have speculated that tougher requirements will be imposed by the UN on poor nations over time as they develop.

The only way this can happen is if there are substantial revisions to the UNFCCC treaty.

China, India and other developing countries have clearly indicated that they will not allow this to happen any time soon.

Chinese negotiator Su Wei summed up the stance of developing nations when he explained that the purpose of the Paris agreement is to “reinforce and enhance” the 1992 convention, not rewrite it.

Canada withdrew from the Kyoto Protocol in part because it lacked legally binding GHG targets for developing countries.

So why is the Harper government supporting a process that will result in our country being stuck in another Kyoto?

In March 2009 while the Environmental Protection Agency was rushing to fulfill a presidential campaign pledge to document that carbon dioxide (CO2) and five other greenhouse gases endangered public health and the environment, a longtime employee, Alan Carlin, put out a 93-page report challenging the science being cited and the drift of the agency from its initial role to one captured by fanatical activists and alarmists, treating environmentalism more as a religion than based in science.

At the time Carlin was a 72-year-old analyst and economist who, as The New York Times put it, “had labored in obscurity in a little-known office at the Environmental Protection Agency since the Nixon administration.” His EPA career would span 38 years.

The website for his new book, “Environmentalism Gone Mad” says, “Dr. Alan Carlin is an economist and physical scientist with degrees from Caltech and MIT and publications in both economics and climate/energy, who became actively involved in the Sierra Club in the 1960s as an activist and Chapter Chairman. This led to a career as a manager and senior analyst at the Environmental Protection Agency.”

As he says in the preface “The purpose of this book is to explain why I changed from my lifelong support of the environmental movement to extreme skepticism concern their current primary objective of reducing emissions of carbon dioxide.”

“Although I and the many other climate skeptics are now referred to as ‘deniers’ by the climate alarmists, that does not change the science—and there is no valid scientific basis for the alarmists’ catastrophic climate predictions—or justify their fantastically expensive and useless ‘solution.’”

Carlin went from being a dedicated environmentalist, based on its initial philosophy of conservation, to an observer of the movement that was taken over and distorted to advocate falsehoods about global warming and a transition from fossil-fuels to “clean energy” meaning wind, solar and bio-fuels. As an economist he understood how absurd it was to suggest rejecting fossil-fuels, the key element of modern industry and society.

“The climate alarmists,” says Carlin, “have now been making their apocalyptic predictions for almost thirty years and it is now possible to compare their predictions with actual physical observations.” Suffice to say all the predictions of a significantly higher temperature—the warming—have been wrong.

In fact, the Earth has been in a natural cooling cycle since 1998 and shows no indication of warming

Predictions about the North and South Poles melting, a major rise in ocean levels, increased hurricanes and other climate events have been wrong along with countless other climate-related apocalyptic predictions.

Having observed how the EPA has functioned for more than three decades, Carlin warns that its current “environmental policy has been hijacked by radicals intent on imposing their ideology by government fiat on the rest of us whether we like it or not…If environmental policy is based on government fiat or ‘green’ policy prescriptions the results have been and are very likely to continue to be disastrous.”

At 625 pages, Carlin’s book takes the reader from his early days as a Sierra Club activist and chapter leader to being an EPA outcast, denounced for telling the truth about the false claims of global warming, climate change, and what is now being called extreme weather.

As an economist, Carlin is particularly upset that “the Obama Administration’s climate/energy policy is wasting very large sums on non-solutions to minor or non-problems.” The book has come along as President Obama has been flogging “climate change” as the greatest threat to the nation and the world.

“It has been long recognized that weather is chaotic," says Carlin. While we operate within the four seasons, the weather that occurs can only be predicted in the most general terms. Suggesting that humans actually have any effect on the weather is absurd.

That is why the predictions made by the UN’s Intergovernmental Panel on Climate Change and all the others based on computer models are, by definition, worthless. Computer models cannot predict anything about the vast chaotic global climate system. Even today, meteorologists are mystified by the actions of clouds which can form and disappear in minutes.

It’s useful to keep in mind that climate is measured in centuries, while the weather is reported as what is occurring today and forecast, at best, for no more than a week. Weather records are maintained for purposes of comparison and within the larger context of determining the Earth’s climate cycles. Like those in the past, the present cooling cycle is based on a comparable one of the Sun that is producing lower levels of radiation. You don’t need a Ph.D. in meteorology to understand this.

Carlin does not hesitate to excoriate the blather put forth by the alarmists; particularly their claims that the weather is affected in any significant fashion by human activity and development in particular. “There is simply no evidence thus far that the normal activities of man have or will result in catastrophic outcomes for either man or nature.”

The actions the alarmists call for do nothing to enhance and benefit our lives. They drive up the cost of energy and food. They ignore how dependent modern life is on the use of fossil fuels.

“Despite all the lavish funding by liberal foundations and the federal government on their global warming doctrine-inspired programs, the radical environmental movement has long since gone so far beyond rationality that it is counter-productive in achieving its own ends.”

So long as it remains heavily funded and backed by the federal government, we must, like Carlin, speak out against environmental extremism.

We must elect new people to govern in a more realistic, science-based fashion.

We must urge our current legislators to rein in the rogue Environmental Protection Agency.

Dominos fall in anti-fossil fuel movement

Throughout the United States, especially in communities with existing or potential oil-and-gas development, outside groups have moved in with a vengeance and agitated the population—resulting in bans against all exploration for hydrocarbons and/or the use of hydraulic fracturing. Expensive lawsuits have been filed and courts have repeatedly declared such bans as “unconstitutional

” The newest domino to fall is in Texas where Governor Greg Abbott, on May 18, signed House Bill 40 (HB40)—also known as the Denton Fracking Bill—which clarifies that an “oil and gas operation is subject to the exclusive jurisdiction of the state.”

As was the case in Mora County, New Mexico, the Pennsylvania-based Community Environmental Legal Defense Fund participated in pushing Denton, Texas’ fracking ban—passed in November by 59 percent of the voters. In Mora County, a federal judge declared its drilling ban “unconstitutional.”

Courts have handed down similar decisions against attempts to ban fracking in Colorado and Ohio. But the Texas legislature didn’t wait for the courts to decide in the challenges to the Denton ban.

Lawmakers introduced a total of 11 bills aimed at confirming that regulating oil-and-gas activity is the province of the Texas Commission of Environmental Quality and the Texas Railroad Commission. HB40 emerged as the final word—making Texas the first state to pass specific legislation limiting, not eliminating, local control.

The Oklahoma legislature has passed a similar bill and Governor Mary Fallin is expected to sign it. In New Mexico, the House passed a pre-emption bill, but it was never brought up for a vote in the Senate.

The Texas law allows communities to impose commercially reasonable ordinances that regulate above ground oil-and-gas activity such as traffic noise, lights, and setbacks—but do not “effectively” prohibit resource extraction.

In response to the new law, Ed Longanecker, President of the Texas Independent Producers and Royalty Owners Association said: “This is a balanced approach that protects the ability of municipalities to reasonably regulate surface activity related to oil and gas development, while offering the regulatory certainty necessary for our industry operations.”

HB40 was crafted with input from the Texas Municipal League—which, the Texas Tribune reports, “counts 1145 Texas cities among its members.” The Texas Municipal League was “initially among the bill’s fiercest critics,” but its involvement “added language listing areas cities could still regulate” and other changes that “the Municipal League found more palatable.”

David Holt, president of the Consumer Energy Alliance, which actively campaigned against the ban, believes “This bill struck the right approach. While local government should have some control over growth, energy development is a statewide issue. Tax revenues go to the entire state. The state agencies have been regulating production for almost 100 years.

An open robust discussion on the proper balance seems to be leading to good results in most local areas. Once folks have all the facts they can and do make good decisions. But those who simply say no energy production anytime or anywhere are doing a disservice to their neighbors and the nation.”

Denton, Texas, sits on top of one of Texas’ biggest natural gas reserves: the rich Barnett Shale— producing $1 billion in mineral wealth, according to the Associated Press, and pumping more than $30 million into city bank accounts. The Texas Tribune reports: “In some cases, neighborhoods are expanding closer to longtime drilling sites.”

The idea of fracking, like the Keystone pipeline, is less of a problem itself than what it represents: more fossil fuels.

In Texas, thanks to fracking, according to the Wall Street Journal (WSJ), oil production has tripled in the past five years. The increase benefits Texas by providing the state with almost $6 billion worth of revenue in fiscal year 2014 through severance taxes. But it is not just fracking—which has been done safely and successfully for the past 65 years—that has created the new American energy abundance.

It is fracking combined with horizontal drilling. But horizontal drilling doesn’t sound bad and fracking does. Plus, the general population doesn’t know what fracking, short for hydraulic fracturing, really is—making it easy to use fear, uncertainty, and doubt to scare the public.

In a 2013 report called Fracking by the Numbers, a group called Environment America redefines fracking. In a box on page 6, it states: “In this report, when we refer to the impacts of ‘fracking,’ we include impacts resulting from all of the activities needed to bring a shale gas or oil well into production using high-volume hydraulic fracturing (fracturing operations that use at least 100,000 gallons of water), to operate that well, and to deliver the gas or oil produced from that well to market.

The oil and gas industry often uses a more restrictive definition of ‘fracking’ that includes only the actual moment in the extraction process when rock is fractured—a definition that obscures the broad changes to environmental, health and community conditions that result from the use of fracking in oil and gas extraction.”

This inaccurate definition allows for the recent spate of minor tremors to be blamed on “fracking,” when, in fact, if they are the result of oil-and-gas activity, they are reportedly caused by injection wells—which “inject” water that comes up as part of the drilling process, into wells miles below the surface. Injection wells, which may be far from the drilling site, can be used whether or not the well is stimulated using hydraulic fracturing.

The U.S. Geological Survey study states: “Hydraulic fracturing, commonly known as ‘fracking,’ does not appear to be linked to the increased rate of magnitude 3 and larger earthquakes.” Yet, anti-fossil fuel groups continue to scare the public with such claims.

Ed Ireland, Executive Director of Barnett Shale Energy Education Council, told me his organization sent out five different mailings to 36,000 households to counter the misinformation spread by drilling opponents.

Supporters of the ban try to claim that it is not a drilling ban, just a fracking ban. However, since the natural resource underneath Denton is shale gas—meaning natural gas is trapped in tight little pockets within the rock—the shale must be fractured to allow the gas to flow out. Conventional drilling methods don’t work with shale. A ban on fracking is a ban on drilling.

While the Legislature has acted and the Governor has signed HB40, with it apt to be a pilot for the national issue and a template moving forward, we likely haven’t heard the last of municipal fracking bans—despite courts repeatedly shooting them down.

Earthjustice attorney Deborah Goldberg, in a CommonDreams.org story on the Texas legislation, says the people of Denton are not ready to give up yet: “We have been proud to represent the proponents of Denton’s ban and we know they will regroup and fight back against this legislative over-reach.”

Ireland says he won’t be surprised if drilling opponents engage in protests of some sorts because they have strongly suggested that they will.

One day after HB40 was signed, Colorado-based Vantage Energy announced: “that they were preparing for ‘frac work’ starting May 27.” According to the Denton Record-Chronicle (DRC), “neighbors reported seeing production equipment being moved to the company’s well site.”

In response, Adam Briggle, president of Frack Free Denton, which campaigned for the ban, told the DRC, he expects Denton residents to continue to fight. In a statement, Briggle said: “We cannot say how this story will unfold, but we do know this dark chapter shall not be the last one written.”

The DRC reports, in an interview regarding Vantage’s planned drilling, that Briggle added he: “couldn’t confirm whether people would stage protests at the site. But it wouldn’t be a stretch to imagine it.”

Perhaps it is a good thing, for now, that lower oil prices are providing what WSJ calls “a natural cooling off period.”

When Oklahoma Governor Mary Fallin signs its “preemption” bill into law, it will be the next domino to fall.

I have been wrestling for some kind of explanation why the President of the United States, Barack Obama, would continue to talk about climate change and urge the global transition from fossil fuels to wind, solar and bio-energy. I have concluded that he thinks everyone, not just Americans, are idiots.

We know he lies about everything, but these two topics are clearly near and dear to his heart.

“Earth climate always has changed, is always changing, and always will change—but not from fossil-fuel use. Solar fluctuations, deep ocean circulation patterns, and other powerful natural forces have driven climate change and weather events throughout Earth’s history and will continue to do so.”

“President Obama’s hubris is breathtaking. He now thinks an army of regulators can control our planet’s temperature and climate by tweaking emissions of plant-fertilizing carbon dioxide, a mere 0.04% of the atmosphere.”

“America’s communities do not need to be protected from climate change. They need to be protected from the excesses of authoritarian presidents and bureaucrats.”

Driessen and I look at and listen to Obama and wonder if others too see and hear someone uttering some of the most absurd claims about the climate. Then we worry that this someone is the President of the United States with the power to turn his ignorance into national policy.

At this point we have suffered his initial failure to respond to the recession he inherited from the 2008 financial crisis. More than six years later the economy has barely moved toward a normal rate of growth. Then we were gifted with ObamaCare and the disruption of what was widely regarded as the best health system in the world. And, for good measure, he imposed Common Core on an already weakened educational system. It is being repealed and opposed in many states. For good measure, his foreign policy, if he has one, is widely regarded as a total failure.

How is it a former “community organizer” possesses a seemingly vast understanding of meteorology? Did they also teach that at the Harvard Law School? “Climate change,” said Obama, addressing a graduating class of the Coast Guard Academy, “constitutes a serious threat to global security, an immediate risk to our national security, and make no mistake; it will impact how our military defends our country.”

“Our military and our combatant commanders,” the President told the Academy graduates, “our services—including the Coast Guard—will need to factor climate change into plans and operations, because you need to be ready.” For what? For a rainstorm? For snow? Wind?

This is the same President who sees no threat to our national security from Iran whose leaders shout “Death to America” every day when they aren’t also shouting “Death to Israel.” He has zealously been pursuing a deal that would enable Iran, the leading supporter of terrorism, to have nuclear weapons. Meanwhile Islamic State (ISIS) is taking over more territory in northern Iraq and into Syria. Obama might as well be dropping bags of marshmallows on them.

He blamed climate change in the form of “severe droughts” for the rise of Islamism in the Middle East and Africa. Someone needs to tell Obama that there have always been severe droughts somewhere on the planet, and floods, and forest fires, and blizzards, and hurricanes. Even so, in the last eighteen years, there have actually been LESS of these natural events, along with the flatlining of the planet’s overall or average temperature—there has been no warming!

Not content to blame climate change for the rise of terrorism, the White House issued a report that was described as “a doomsday scenario of health, security, economic and political issues.” The thing about climate is that it measured in centuries, not years. As for the weather, while records are maintained, it is usually reported as today’s news with a forecast of the coming week.

So you shouldn’t be surprised that the report blamed “asthma attacks” on climate change!

Suffice to say there isn’t a glimmer of hard evidence to support anything the President is saying these days about climate change.

And this is the same President that wants the U.S. and the rest of the world to give up the use of fossil fuels—coal, oil and natural gas—to “stop climate change.”

IF Obama’s climate change idiocy is just a way to distract Americans from the real problems we have encountered thanks to his failure to address them, then it is purely cynical and political.

And if Obama really believes this stuff, he is unfit to be President.
